Denied Short Term Disability

Tue, 11/17/2009 - 17:25

I had a seizure in July after being seizure-free for ten years.  I decided to take a 4 month leave of absence from my position as an instructional assistant.  I filed for short-term disability and received the first month's disability until they research whether or not my condition was pre-existing.  They found that it was because I had seen a doctor for it in 2008 and I had to have not been treated for it 2yrs. ago.  The only reason why I went to that doctor was to get medicine refills.  This family practitioner had stop checking my tegretol level years ago telling me that if it was gonna damage my liver it would have done so years ago.  I moved from MS to Tx and started seeing a epileptologist.  After getting off of Keppra, then changing to lamictal I had a seizure.  I think this had to do with the fact that Wal-mart gave me the generic brand.  I think it is ridiculous that I was allowed to pay for short-term disability and wasn't asked about any pre-existing conditions then.  Now when I need to use it, they start questioning this.

To top things off, I don't think the school district will let me come back once my leave is over.  Should I even bother to request a hearing or for the company to reconsider? I am angry because I finally felt like I had control of my life.  Now I've had to move back to MS for the time being because we can't afford to live in TX with just one income.  This sucks big time.
