Insurance and Divorce

If you have had a private PPO insurance policy for over twenty years but it is in your husband's name and you are considering divorce, what can you do to protect yourself? I have heard that you have to sue your husband within the divorce for continuing your insurance and I also read in the brochure that one reason for cancellation of the policy is divorce. Since my children are getting to the age of individual policies anyway, would it be possible for me to switch to an individual policy too before any divorce is filed? Any help would be appreciated. Hi Joan, You might want to check with the insurance company about switching your joint policy to 2 individual policies. If it was an employer issued policy, you might be covered under the COBRA plan for 18-36 months. I'm not sure what the private policy allows. I do know that getting private insurance is difficult once you have a diagnosis of epilepsy. Thanks Barbie, It is not employment issued insurance policy. It is an individual policy listing only our family members. I can't ask my agent because he is my FIL so I guess I'll see if there is a state regulatory agency that covers it. Thanks Hugs Joan

Dear Joan, I believe that any good divorce attorney cant make sure that the spouse is covered by the exisiting policy if they have a quilfiying medical condition that would not allow them to get reasonable coverage on there own. They add it to the part with spousle support and remember that california law says after 8 years without a prenup that everything is 50/50 although the judges do have a tendency to give the wife more. And if you are talking about yourself then with all the physical issue you face you are bound to do better. I can offer you alittle more info but I will Email it to you for alittle more privacy.
